Same problem. Same wifi works on other same laptop but not kali linux 1.0.9 one.If I disconnect internet then start it works for a few seconds, then stops.I think it maybe the way kali is configed...

Installed kali linux 1.0.9 ISO on USB flash. Got everything working with persistence, and LUKS encryption.Put in USB start kali linux connect to my WiFi network enter pass everything works good....
