after along search and discoveries, philsmd from hashcat group and i found the way to solve the issue. the soultion of leaving 3.7-trunk-kernel and new drivers for newer version of hashcat...

and then running :

lsmod |grep rtl
if you are sure that they are there try :

modprobe -v rtl8187
