fglrx-modules-dkms(your architecture here).deb will not build

i have installed flgrx drivers and at the second to last step buildiing the *.deb for the patch file my output is:

dpkg-deb -b build fglrx-modules-dkms_1%3a14.4.2-1kali1_amd64.deb
dpkg-deb: error: reading package info file 'build/DEBIAN/control': Is a directory

i have read a few tutorials and i followed them to a T but i have tried modifying the build path

by the way i am running GNOME Kali1.0.9 64 bit version

build/DEBIAN/control should be a file. Not a directory. It contains build information.
