AR9462 not injecting in 5ghz band

So, I have an AR9462, monitor mode works perfectly in all bands. Injection works fine in 2.4ghz bands but not 5ghz. Using ath9k on latest rolling. Ideas?

i have same card. this the ouptut:

all APs are on 5.2GHz

Everytime I try, it waits for a beacon frame and never finds it. Even if airodump is currently seeing them.

probably you need to patch driver? or even kernel. because i'm on 3.x.x and it works fine with patched backports 3.18
